The extraction of foreigners and stateless persons from the territory of the Republic of Azerbaijan

1. Extraction of foreigners and stateless persons having no immigration status from the boundaries of the Republic of Azerbaijan

If the foreigners and stateless persons having no immigration status – otherwise foreigners and stateless persons temporary staying or living in Azerbaijan - violate the requirements of the legislation on legal status of foreigners and stateless persons in the Republic of Azerbaijan, can be extracted from the boundaries of the Republic of Azerbaijan according to the decision of Ministry of Internal Affairs of the Republic of Azerbaijan, State Migration Service of the Republic of Azerbaijan or the courts of the Republic of Azerbaijan.

In case foreigners and stateless persons having no immigration status – otherwise foreigners and stateless persons temporary staying or living in Azerbaijan – are suffering from human trafficking, the extraction from the boundaries of the Republic of Azerbaijan is not applied for 1 year and they are registered in accordance with the rules defined by legislation. 
Extraction from the boundaries of the Republic of Azerbaijan is not applied to the children suffering from human trafficking.
Victims of human trafficking whose personality cannot be identified is extracted from the boundaries of the Republic of Azerbaijan.

2. Extraction of immigrants from the boundaries of the Republic of Azerbaijan

The Court (judge) takes decision on depriving the immigrant status of foreigners and stateless persons (otherwise immigrants having permissions for permanent residence in Azerbaijan) and extracting them from the territories of the Republic of Azerbaijan. 
The decision about the extraction of immigrants from the territory of the Republic of Azerbaijan is not concerning his/her family members.
